2. reserve the right to cancel affected orders and refund the charge to you as your sole remedy. The Company reserve the right to change product pricing and discounts offered at any time. IN THE EVENT PRODUCT PRICING CHANGES WITH RESPECT TO WINE CLUB SHIPMENTS, THE COMPANY WILL NOTIFY YOU IN ADVANCE OF SUCH PRICE MODIFICATION AND YOU WILL HAVE THE OPPORTUNITY TO CANCEL YOUR MEMBERSHIP TO THE WINE CLUB PRIOR TO BEING CHARGED FOR YOUR NEXT SHIPMENT.

At Pizzaioli, our goal is to obtain the finest wines from around the world for your convenience, exploration, and enjoyment, locker storage is not intended for long term storage in excess of one month but to be consumed during that month’s wine club release. The customer may not add to the locker any items not purchased from Pizzaioli or opened wine bottles.
Once a Customer has subscribed to our wine club a sales order will be created and recurring billing established. Once the wine club selections are released, those bottles become the legal property of the Customer whether they are requested for pickup or placed in the locker storage at Pizzaioli. Pizzaioli will not accept “returns” for wines removed from a locker or after 30 days of locker storage nor will Pizzaioli refund the value of locker wines if a Customer later changes their mind. Lost customer key replacement will be subject to a $25 fee.
Wines for Dining or Pick Up Terms
For consumption at Pizzaioli, wines are available during regular restaurant hours at a limit of 1 bottle for 2 diners over 21 years of age. Free corkage for all Pizzaioli wine club selections.
Pick up services for wines to be consumed away from our restaurant are available Monday thru Friday with 48 hours’ notice.
Release of Pizzaioli’s Liability
Pizzaioli assumes no liability for any loss, damage or deterioration of wines stored and Customer assumes all risk of loss or damage, including spoilage, cork breakage, change of taste, theft or otherwise from any and all causes.
While the wine storage area is maintained in normal restaurant dining temperature, Pizzaioli does not guarantee or warrant that it is suitable for Customer’s wine and Pizzaioli expressly disclaims any implied warranties of environmental suitability.
Pizzaioli will make reasonable efforts to maintain the cooling system in good working order but does not guarantee or warrant that fluctuations in the humidity or the temperature in the storage area will not affect the quality or taste of Customer’s wine.
For long term storage in excess of 30 days, Pizzaioli strongly recommends that Customer includes the value of their wine in their homeowners' policy to cover any loss or damage to their stored wine.
In the event of damage due to fire, Pizzaioli does carry fire insurance and will refund the client for the value of the original purchase of their wines. However, due to the rarity of wines featured (i.e., sell out quickly and not available for replacement), Pizzaioli will not be able to guarantee the replacement of the exact same bottles/vintages lost.
Pizzaioli will be held harmless in the event of any Act of God, including any natural disaster.
Overdue Payments and Liens
An account must be paid in full and current before Pizzaioli will release any purchased wine for pickup. If an account remains overdue for thirty (30) days after Customer has been notified, Pizzaioli has the right to liquidate the customer's wine locker’s contents under California law. If Customer fails to respond to such thirty (30) day notice, Pizzaioli may deem the wine abandoned and sell the wine. The proceeds shall be first applied to any indebtedness owed to Pizzaioli, as well as any costs and expenses incurred with respect to the goods, the sale, and any efforts to collect such indebtedness. Any excess shall be remitted to the Customer pursuant to California law.
